CamasNET, Inc. - ACCEPTABLE USE POLICY.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE OPENING OR CONTINUING A DIAL-UP ACCOUNT WITH CAMASNET, INC. PLEASE ALSO FAMILIARIZE YOURSELF WITH CAMASNET, INC.'S, ACCEPTABLE USE POLICIES. These Terms and Conditions in conjunction with Acceptable Use POLICIES, represent the complete Agreement and understanding between CamasNET, Inc., and you, the CamasNET, Inc., subscriber, and supersede any other written or oral agreement pertaining to your CamasNET, Inc., services. By using CamasNET, Inc.'s, services, you agree to be bound by and to comply with this Agreement, just as if you had signed it. Violation of any provision of this Agreement is grounds for immediate termination of your CamasNET, Inc., account.

IF YOU DO NOT AGREE TO BE BOUND BY THESE ACCEPTABLE USE POLICIES, YOU SHOULD IMMEDIATELY END YOUR USE OF CAMASNET, INC., SERVICES AND SOFTWARE, AND NOTIFY CAMASNET, INC.'S, HELPDESK SO THAT THEY MAY INITIATE A CLOSURE OF YOUR ACCOUNT.

 PART A - ACCEPTABLE USAGE POLICIES OF DIAL-UP ACCOUNTS:

Subscriber's and their Users agree to use dial-up accounts solely on an active dial-up basis, meaning only as needed and in no way on a standby or inactive basis in order to maintain a connection. Without limitation of the foregoing, Subscriber and their Users shall abide by the following provisions regarding usage: The following are violations of CamasNET, Inc. policies:

  1. Revealing Subscriber's account password to others or allowing use of Subscriber's account or e-mail addresses by others (other than residents in Subscriber's household) is strictly prohibited. Business accounts are for single business use only. Businesses may not supply employees with account passwords or access for use at home.
  2. At no time can there be simultaneous use of the same user name and password combination, or simultaneous login of a lead account and any of its e-mail box combinations. Only one login per lead account, including additional e-mail boxes, is allowed at any one time. An e-mail box does not constitute an account.
  3. Using CamasNET, Inc. services for illegal purposes, or in support of illegal activities. CamasNET, Inc. reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong. Activities which are prohibited as potentially illegal include, but are not limited to: - Unauthorized copying of copyrighted materials including, but not limited to, digitization and distribution of photographs from magazines, books or other copyrighted sources and copyrighted software. - Exporting software or technical information in violation of U.S. export control laws. - Posting or e-mailing of scams such as 'make-money-fast' schemes.
  4. Posting or transmitting charity requests, petitions for signatures, chain letters or letters relating to pyramid schemes. Posting or transmitting any advertising, promotional materials or any other solicitation of other users of the Service for goods for services in those areas (e.g., a classified bulletin board) that are designated for such purposes.
  5. Threatening bodily harm or property damage to individuals or groups.
  6. Making fraudulent offers of products, items, or services originating from Subscriber's account.
  7. Attempting to access the accounts or passwords of others, or attempting to penetrate beyond security measures of our or other systems (referred to as hacking) whether or not the intrusion results in corruption or loss of data.
  8. Harassing others by Mail-Bombing or News-Bombing. Mail Bombing constitutes sending more that ten (10) similar e-mail messages to the same e-mail address. News-Bombing constitutes sending more that 2MB of data to a newsgroup.
  9. Posting or listing articles which are off-topic according to description of the group or list or send unsolicited mass e-mailings to more than fifteen (15) e-mail users.
  10. Forging any message header, in part or whole, of any electronic transmission, originating or passing through CamasNET, Inc., services.
  11. Distributing viruses to or from CamasNET, Inc., systems.
  12. Use of any software or any device that would allow your account to stay logged on while subscribers is not in active use of CamasNET, Inc., services or use of the account for the purpose of operating a server of any type.
  13. Exceeding 1 GB of traffic in a one month period.
  14. Cross-posting advertisements for products, items, or service to ten (10) or more unrelated newsgroups.
  15. Posting articles to any newsgroup, mailing list or similar forum which are off-tropic according to the charter or other public statement for the forum.
  16. Disrupting any newsgroup with frivolous, excessively vulgar or repetitious postings.
  17. Posting of binary, or excessively large, unrelated text to non-binary newsgroups that have specifically requested such material not be posted in the group's FAQ (Frequently Asked Questions).
  18. Sending "inline" binary e-mail messages. If sending binaries, these files should be "attached" to the email message, not contained within the body of the message. Failure to do so could cause server damage, in which case the subscriber could be held liable.
  19. Sending e-mail messsages that exceed one (1) MB. Excessively large e-mail messages can clog an inbox, and cause server slowdown.
  20. Installation of 'auto-responders', cancel-bots' or similar automated or manual routines which generate excessive amounts of Internet traffic, or disrupt Internet newsgroups or e-mail use by others.
  21. Engaging in any of the above activities using the service of another provider but channeling such activities through a CamasNET, Inc., account or re-mailer, or using a CamasNET, Inc., account as a mail drop for responses.
  22. No Spam. "SPAM" is the net name for unsolicited electronic mail or newsgroup postings offering products, services, or get-rich-quick schemes. As a new communications medium, the Internet is a natural place for commerce but, because it is growing so quickly, it attracts some who are ready to take advantage of its fast growth and few rules. We have received complaints about CamasNET subscribers SPAMing. We take them very seriously. Too many complaints could slow down our system's performance and inconvenience other subscribers. A spammer invoking the anger of users on the 'Net could find his/her mailbox filled with irate responses in a matter of hours, rendering the mailbox useless. Complaints from other ISP's about one of our subscribers stealing services from them (including but not limited to Spamming, unsolicited bulk e-mail, pinging, smurfing, etc.) automatically puts the subscriber in violation of our "Acceptible Use" policy. CamasNET will take action by suspending a spammer's account until the matter is cleared up, or by asking spammers to take their business elsewhere. Spamming includes but is not limited to:
    (1) The bulk sending of unsolicited messages or the sending of unsolicited e-mails which provoke complaints from the recipients,
    (2) The sending of junk mail.
    (3) The use of distribution lists that include people who have not given specific permission to be included in such distribution process.
    (4) Posting commercial ads to CamasNET, Inc. newsgroups that do not permit it.
    (5) Posting articles containing binary encoded data to a non-binary newsgroups.
    (6) Excessive and repeated posting off-topic messages to newsgroups.
    (7) Excessive and repeated cross-posting to newsgoups.
    (8) E-mail harassment of another Internet user or users, including but not limited to, transmitting any threatening, libelous or obscene material, hate mail, or material of any nature which could be deemed to be offensive.

Subscribers found in violation of the CamasNET, Inc., usage policies may be subject to other damages as a result of violation of this agreement. Subscribers who violate any usage policies will receive a written warning via email.  A second violation notice will again warn the subsriber.  A third violation will result in termination of the subscriber's account.

INACTIVITY DISCONNECT POLICY:

CamasNET, Inc., reserves the right to disconnect a dial-up account after twenty (20) minutes of inactivity, as detected by CamasNET, Inc., through electronic means. This time is approximate and subject to change without notice at CamasNET, Inc.'s, sole discretion.   

Electronic or mechanical means to avoid an inactivity disconnect are strictly prohibited. 

No BOTS. A BOT (short for roBOT) is a piece of software designed to keep a line up at all times. It can take many forms. Configuring an email program to check for mail every 5 minutes is a BOT. The program will check for mail 288 times in a 24 hour period, never allowing the modem to hang up. Other BOTS include, but are not limited to "pinging" the mail server, employing electronic or software auto-dialer features to maintain an active connection.  An unmetered account does not mean holding onto a single modem line for days at a time. At our discretion, we will terminate connections running too long. Or, like spammers, ask BOT users to subscribe to another Internet service provider. 

No Camping. Camping is leaving your Internet connection up for extended periods of time while not directly in use. This may include anything from hours to days to weeks. Some examples of when an Internet connection are not needed are:

    • When using Office Programs such as Word, Excel, or Publisher
    • Writing long e-mail messages
    • When you are not at your computer terminal

Camping causes line congestion, which eventually leads to adding more lines that are not really necessary for operating. This policy is not meant to limit Internet use, but to provide greater online utilization by all customers.

CamasNET, Inc., reserves the right to electronically audit connections.  Subscribers found to be in violation of this policy face account termination pending a review by the Board of Directors. CamasNET, Inc. also reserves the right to disconnect a dial-up account after two hours during peak traffic hours to allow others the opportunity to connect. If disconnected in such a manner, subscriber can immediately dial back in.

Subscribers found in violation of the CamasNET, Inc., usage policies may be subject to other damages as a result of violation of this agreement. Subscribers who violate any usage policies will receive a written warning via email.  A second violation notice will again warn the subsriber.  A third violation will result in termination of the subscriber's account.

 

PART B - Conditions

  1. A list of ways to contact CamasNET, Inc., is available on the World Wide Web at http:// www.camasnet.com. Specific questions about this agreement should be directed to the help desk.
  2. Subscriber acknowledges that Internet sites and use of the Internet might consist of, include and/or provide access to images, sound, messages, text and other content and material that may be unsuitable for children and that may be objectionable to many adults. Subscriber acknowledges that CamasNET, Inc., is not responsible for any such content or material and agrees that access to same through use of CamasNET, Inc., is at Subscriber's sole risk. Subscriber acknowledges that, when using the Internet, Subscriber generally is using a physical network and accessing content, information and other services not owned, supported, monitored or controlled by CamasNET, Inc. Subscriber acknowledges that safeguards relative to copyright, ownership, decency, obscenity, reliability and integrity of content may be entirely lacking with respect to the Internet and content accessible through it. Subscriber assumes all risk and liability of his/her use of the Internet, including continuous compliance with this Policy Agreement. Subscriber further understands that the Internet contains unedited materials some of which are sexually explicit or may be offensive to you. Subscriber accesses such materials at his or her own risk. CamasNET, Inc., has no control over such materials.
  3. Subscriber is responsible for and must provide all telephone and other equipment and services necessary to use CamasNET, Inc.'s services.
  4. Unless otherwise agreed, Subscriber's right to use the Service or to designate users is not transferable and is subject to limits established by CamasNET, Inc.
  5. Subscriber agrees to provide CamasNET, Inc., with accurate and complete billing information, including legal name, address and telephone number, and to update this information within 15 days of any change. Payment of a CamasNET, Inc., account by fraudulent means will result in immediate and permanent termination of the account and possible criminal penalties.
  6. Subscriber's accounts are to be paid in advance and will be considered delinquent if payment has not been received by CamasNET, Inc., by the 20th of the month.
  7. CamasNET, Inc., reserves the right to charge a service reconnection fee to reinstate suspended accounts.
  8. If Subscriber believes CamasNET, Inc., has billed them incorrectly, they must contact CamasNET, Inc., no later that 30 days after the closing date on the first billing statement in which the error or problem appeared, in order to receive an adjustment or credit. Inquiries should be directed to CamasNET, Inc.'s billing address either by postal mail or e-mail.

  9. To cancel an account, Subscriber must contact CamasNET’s billing department via e-mail, phone, or postal mail. Cancellation requests must be received by the 20th of the current month in order to be processed before the beginning of the next accounting cycle. Cancellation requests must contain Subscriber's user name, Subscriber's name address and phone number and other identifying information as they appear on their billing record.
  10. All CamasNET, Inc., charges must be paid in full before a cancellation will be considered complete.
  11. "As Is" Services. Subscriber acknowledges that CamasNET services are provided "as is". CamasNET, Inc., its employees, agents, suppliers, vendors, and distributors make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity of the data and or information available on its systems, or residing on or passing through its interconnecting networks, or that CamasNET, Inc.'s, services will be uninterrupted or error free. CamasNET, Inc., expressly excludes any implied warranty of merchantability or fitness for a particular purpose to the fullest extent possible by law.
  12. The Subscriber also understands that CamasNET, Inc., cannot and does not guarantee or warrant that files available for downloading through the service will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. Subscriber is responsible for implementing sufficient procedures and checkpoints to satisfy Subscribers particular requirements for accuracy of data input and output, and for maintaining a means external to the Service for the reconstruction of any lost data. Subscriber assumes total responsibility and risk for his or her use of the service and the Internet. CamasNET, Inc., does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, any merchandise, information or service provided through the service or on the Internet generally, and CamasNET, Inc., shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely subscriber’s responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Service or on the Internet generally. CamasNET, Inc., does not warrant that the service will be uninterrupted or error-free or that defects in the service will be corrected. The Service is provided on an "as is, as available" basis.
  13. Subscriber agrees to waive and hold CamasNET, Inc., harmless from any claims relating to any action taken by CamasNET, Inc., as part of its investigation of a suspected violation of this agreements or as result of its conclusion that a violation of this Agreement has occurred. This means that Subscriber cannot sue or recover any damages whatsoever from CamasNET, Inc., as a result of CamasNET, Inc.'s, decision to remove material from its servers, cancel a newsgroup posting, warn subscriber, suspend or terminate Subscriber's account, or take any other action during the investigation of a suspected violation or as a result of CamasNET, Inc.'s conclusion that a violation has occurred. This waiver applies to all violations described in the Acceptable Use Policies.
  14. IN NO EVENT SHALL CAMASNET, INC., BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE OR OTHER CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS) ARISING OUT OF OR IN RELATION TO THIS AGREEMENT OR THE SUBSCRIBER'S USE OF OR INABILITY TO USE CAMASNET, INC.'S SERVICES. CAMASNET, INC.'S, ENTIRE LIABILITY AND SUBSCRIBER'S EXCLUSIVE REMEDY SHALL BE AT CAMASNET, INC.'S, OPTION - EITHER RETURN OF THE SERVICE FEES PAID FOR THE CURRENT MONTH OF SERVICE AND ANY SET-UP FEES PAID. In any case, CamasNET, Inc.'s, entire liability under or arising out of this Agreement shall be limited to the amount the Subscriber paid for the service in the last 30 days prior to the act or injury that gave rise to the liability. However, some jurisdictions may not allow a limitation on liability for negligence that causes death or personal injury, and CamasNET, Inc.'s, limits its liability in such jurisdiction only to the degree allowed by the applicable laws.

 

PART C. USE OF SERVICES

  1. During an investigation, CamasNET, Inc., may suspend the account or accounts involved and/or remove the material involved from its servers. If CamasNET, Inc., believes, in its sole discretion, that a violation of these policies has occurred, it may take responsive action.. Such action may include, but is not limited to, damages, temporary or permanent removal of material from CamasNET, Inc., servers, the cancellation of newsgroup posts, warnings to the subscriber or subscribers responsible, and the suspension or termination of the account or accounts responsible. CamasNET, Inc., in its sole discretion, will determine what action will be taken in response to a violation on a case-by-case basis. Violations of these Policies could also subject the subscribers to criminal or civil liability.
  2. Subscriber of record is responsible for all use of the account, with or without the knowledge or consent of the subscribers. If you believe that your account is being accessed by others contact the helpdesk.
  3. Subscriber may not store or distribute certain other types of material on CamasNET, Inc., servers. Examples of prohibited material include, but are not limited to, programs containing viruses or trojans and tools to compromise the security of their sites.
  4. CamasNET, Inc., staff may monitor the security of subscriber's passwords at any time, A subscriber with an insecure password may be directed to change the passwords to one which complies with CamasNET, Inc.'s policies. Subscribers who repeatedly choose insecure passwords may be assigned a password by CamasNET, Inc.; continued failure to maintain password security may be grounds for account termination.
  5. Subscriber is prohibited from utilizing CamasNET, Inc., services to compromise the security or tamper with system resources of accounts on computers at CamasNET, Inc., or at any other site. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.
  6. Subscriber may not run programs which provide network services from their account. Examples of prohibited programs include, but are not limited to, e-mail, http and IRC servers and multi-user interactive forums, without prior approval from CamasNET, Inc.
  7. Subscriber may not post or transmit any message anonymously or under a false name.
  8. Subscriber may not post or transmit any message which is libelous, defamatory or which discloses private or personal matters concerning any person. Subscriber may not post or transmit any message, data, image or program which is indecent, or obscene or pornographic.
  9. Subscriber may not interfere with other users' use of the service.
  10. Subscriber may not post or transmit any message which is harmful, threatening, abusive or hateful. It is not the CamasNET, Inc.'s, intent to discourage Subscribers from taking controversial positions or expressing vigorously what may be unpopular views; however CamasNET, Inc., reserves the right to take such action as it deems appropriate in cases where the Service is used to disseminate statements which are deeply and widely offensive and/or harmful.

Subscribers found in violation of the CamasNET, Inc., usage policies may be subject to other damages as a result of violation of this agreement. Subscribers who violate any usage policies will receive a written warning via email.  A second violation notice will again warn the subsriber.  A third violation will result in termination of the subscriber's account.

 

PART D. MISCELLANEOUS

  1. CamasNET, Inc., will not monitor or disclose the contents of a subscriber's private communication unless required to do so by law or in the good faith belief that such action is necessary to protect and defend CamasNET, Inc.'s, rights or property, or under exigent circumstances to protect the personal safety of its customers or the public.
  2. CamasNET, Inc., will monitor e-mail accounts for amount of storage that subscribers are occupying on the CamasNET, Inc., server. CamasNET, Inc., reserves the right to "dump" all e-mail messages if combined messages exceed 5 MB of storage. If subscriber has a homepage, 5MB of storage includes both email messages, Web space, and any other files subscriber has stored on the CamasNET server. If subscriber continually exceeds this limit they will be required to purchase additional space.
